These Terms and Conditions (“Terms”) govern access to and use of CurlyLifestyles.com and all related memberships, services, features, content, and offerings (collectively, the “Service”). The Service is owned and operated by Curly Lifestyles Media Inc. (“Curly Lifestyles,” “we,” “us,” or “our”).
By accessing the Service, creating an account, purchasing a membership or service, submitting content, or otherwise using the platform, you agree to be bound by these Terms.
1. Definitions
Curly Lifestyles refers to Curly Lifestyles Media Inc.
Member refers to any individual or business that accesses or uses the Service.
CL Membership refers to an annual membership that provides access to the Curly Lifestyles platform, including the ability to publish Content and participate in available platform features as described at the time of purchase.
Contributor refers to a named individual stylist, consultant, barber, curly hair influencer, or other knowledgeable individual whose identity is attached to published Content.
Paid Services refers to optional services available for purchase, including but not limited to content reviews, editorial features, challenge participation, filming support, editing support, and website advertising.
Content refers to all text, images, videos, audio, scripts, captions, links, and materials submitted, published, or shared through the Service.
2. General Terms
These Terms apply to all use of the Service and all communications between you and Curly Lifestyles, including electronic communications. Curly Lifestyles reserves the right to update or modify these Terms at any time. Changes take effect upon posting. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
3. Eligibility, Accounts, and Publishing Rules
CL Membership is intended for barbers, stylists, consultants, curly hair influencers, and other knowledgeable individuals operating in compliance with applicable laws, licensing requirements, and professional standards where required.
Membership may be purchased by an individual or by a business on behalf of a named Contributor. All published Content must be attributed to a named Contributor. Business or salon profiles may not publish Content directly. The Contributor is solely responsible for the Content they submit or publish.
You represent that all information provided, including credentials, experience, services, and booking or contact links, is accurate, current, and not misleading.
Curly Lifestyles reserves the right to approve, decline, suspend, or remove any account, profile, Content, or participation at its sole discretion.
4. Membership Fees, Renewal, and Pricing
CL Membership is billed annually and renews each year unless canceled prior to the renewal date.
By purchasing a membership, you authorize Curly Lifestyles to charge the applicable annual fee and taxes to your selected payment method at each renewal.
Promotional or founding pricing may be offered from time to time. Unless explicitly stated in writing, pricing is not locked and may change at renewal.
Membership provides access to the platform and eligibility for features available at the time of purchase. Membership does not guarantee visibility, promotion, leads, bookings, revenue, or outcomes.
Membership fees are non-refundable except where required by law.
5. Paid Services, Scope, and No Guarantees
Paid Services are optional and are not required to maintain a CL Membership or to publish Content on the Curly Lifestyles platform.
Paid Services provide curated visibility, editorial positioning, and general guidance only. Curly Lifestyles does not provide advertising guarantees, performance-based marketing, or agency services.
Impressions, traffic, engagement, inquiries, leads, bookings, sales, and results are not guaranteed.
Your purchase covers only the deliverables explicitly listed at the time of purchase. Add-ons apply only to the specified deliverables and do not increase deliverables unless stated in writing.
Delivery timelines begin once all required information has been received and approved.
Travel within Ontario may be included in certain packages as described at the time of purchase. Travel outside Ontario may require additional costs and will be quoted separately.
6. Filming and Editing Support
Where offered, filming and editing services are provided as content preparation support only. They are not professional video production services and are not intended to meet broadcast or agency-level production standards.
On-site filming is subject to location limits, availability, time constraints, and advance scheduling confirmation.
If submitted footage does not meet minimum requirements, resubmission or adjustments may be requested.
7. Editorial Review and Discretion
All profiles, Content, features, advertising placements, and publishing-related services are subject to editorial review and approval at Curly Lifestyles’ sole discretion.
Curly Lifestyles may approve, decline, edit, delay, limit visibility, reschedule, or remove Content or services for reasons including quality, accuracy, safety, brand alignment, availability, platform strategy, or community standards.
Participation or purchase does not guarantee publication, timing, placement, format, or continued visibility.
8. No Reliance, Education, and Medical Disclaimer
All Content, education, scripts, captions, tips, routines, techniques, and guidance are provided for general educational and informational purposes only.
You agree that you do not rely on Curly Lifestyles for business, financial, marketing, legal, or medical advice. Any decisions you make based on participation in the platform are made at your own discretion and risk.
Curly Lifestyles does not provide medical advice and does not verify medical, scalp health, hair loss, allergy, or treatment claims. Users should consult qualified medical professionals for health-related concerns.
9. Professional Responsibility and Assumption of Liability
Members and Contributors are solely responsible for their services, advice, representations, pricing, credentials, licensing where applicable, sanitation practices, insurance, client communication, and outcomes.
Members and Contributors may not represent that Curly Lifestyles employs, certifies, endorses, verifies, or guarantees their services, advice, or expertise.
You accept full responsibility for any harm, injury, allergic reaction, dissatisfaction, financial loss, reputational harm, or damages arising from your services, advice, Content, or conduct.
10. Content Ownership and License
Members retain ownership of their Content.
By submitting Content, you grant Curly Lifestyles a worldwide, royalty-free, non-exclusive license to host, display, distribute, reproduce, and promote the Content across the platform and Curly Lifestyles marketing channels. Minor edits for formatting or platform compatibility may be made without altering meaning.
You represent that you own or have permission to use all submitted Content, including music and images, and that written consent has been obtained from any identifiable individuals featured.
Content may be removed immediately if ownership, consent, authenticity, or accuracy is disputed.
11. Directory Placement and Visibility
Directory placement, search visibility, category positioning, and featured placement are determined by platform design and editorial discretion.
Curly Lifestyles does not guarantee rankings, impressions, traffic, engagement, inquiries, leads, or bookings.
12. Website Advertising
Website advertisements run for the purchased duration and are displayed based on available inventory.
Website ads do not include social media promotion unless explicitly stated.
Impressions, clicks, conversions, or results are not guaranteed.
13. Third-Party Services
The Service may link to third-party booking platforms, websites, or tools. Curly Lifestyles is not responsible for third-party services, including availability, errors, refunds, data handling, or disputes.
14. Promotions and Scheduling
Any welcome posts, reposts, features, or campaign inclusions are subject to availability and editorial planning.
Eligibility does not guarantee frequency, timing, format, or selection.
15. Intellectual Property
All Curly Lifestyles branding, logos, trademarks, badges, and proprietary materials are the exclusive property of Curly Lifestyles Media Inc.
Members may display platform badges for promotional purposes but may not alter branding or imply certification or endorsement.
16. Community Standards
Curly Lifestyles maintains a zero-tolerance policy for discrimination, harassment, hate speech, plagiarism, copyright infringement, misrepresentation, or unlawful Content.
Accounts or Content violating these standards may be removed or suspended.
17. Disputes, Claims, and Third-Party Harm
Curly Lifestyles is not responsible for disputes, claims, or complaints between Members, Contributors, or any third party, including claims related to dissatisfaction, allergic reactions, injury, misuse of advice, financial loss, or alleged harm caused by Content or services.
18. Cancellation Policy for Paid Services
Paid Services may be canceled within 24 hours of purchase by emailing info@curlylifestyles.com, provided that work has not begun. After 24 hours, all service purchases are final.
If required information is not provided within seven days of request, the service will be considered complete and closed.
19. Refund Policy for Paid Services
Refunds are available only if a cancellation request is submitted within 24 hours of purchase and before work has begun.
After this period, no refunds will be issued regardless of engagement, outcomes, or results.
Refunds will not be provided for delays or non-completion caused by missing or late information. If a service cannot be fulfilled prior to work beginning, a refund or alternative option may be offered at Curly Lifestyles’ discretion.
20. Platform Availability
Curly Lifestyles does not guarantee uninterrupted access to the Service and may modify, suspend, or discontinue features at any time without liability.
21. Force Majeure
Curly Lifestyles is not liable for delays or failures caused by events beyond reasonable control, including acts of God, power outages, internet failures, legal changes, illness, or third-party platform interruptions.
22. Termination
Curly Lifestyles may suspend or terminate accounts that violate these Terms or community standards. Termination does not entitle Members to refunds unless required by law.
23. No Agency or Partnership
Nothing in these Terms creates an employment, agency, partnership, joint venture, or legal relationship between you and Curly Lifestyles.
24. Indemnification
You agree to indemnify, defend, and hold harmless Curly Lifestyles Media Inc., its officers, directors, contractors, and affiliates from any claims, losses, damages, liabilities, and legal fees arising from your Content or services, harm or injury caused by advice you shared, your business practices or representations, claims relating to lack of sales or results, or your violation of these Terms.
25. Disclaimer of Warranties
The Service is provided “as is” and “as available.” To the fullest extent permitted by law, Curly Lifestyles disclaims all warranties, express or implied.
26. Limitation of Liability
To the maximum extent permitted by law, Curly Lifestyles Media Inc. is not liable for indirect, incidental, consequential, or punitive damages.
Where liability cannot be excluded, total liability shall not exceed the amount paid by you to Curly Lifestyles for the specific Paid Service giving rise to the claim in the three months prior, or the annual membership fee for membership-only claims.
27. Governing Law
These Terms are governed by the laws of the Province of Ontario and the laws of Canada applicable therein. Disputes shall be resolved exclusively in Ontario courts.
28. Miscellaneous
Failure to enforce any provision is not a waiver. If any provision is unenforceable, the remainder remains in effect. Any feedback, ideas, or suggestions submitted may be used by Curly Lifestyles without compensation or obligation.
29. Privacy
Personal information is handled in accordance with our Privacy Policy and applicable Canadian privacy laws, including PIPEDA.
